Justine Webster Photography (“Photographer”) is a photography business located in Brooklyn, New York. By hiring Photographer, the Client agrees to the terms set forth below.
Rates and Payment Schedule:
A non-refundable retainer of $200 reserves the date of the session and secures the services of Photographer. This retainer will be applied toward the session. The remaining balance is due at or before the time of the session. Rates are subject to change without notice. The Client will receive rates posted at the time of booking. In the event of cancellation, the retainer fee paid is non-refundable.
Limits of Liability:
Photographer is not liable for any unplanned delays or cancellations due to extreme weather, transportation complications, illness, emergency, or other unforeseen events. In the unlikely event Photographer is unable to perform services, Photographer will make every effort to reschedule the session within a reasonable amount of time. If this is not possible, responsibility and liability is limited to the return of all payments received for the session. In the unlikely event that Photographer’s files are lost, stolen, or destroyed for reasons within or beyond Photographer’s control, Photographer’s liability is limited to the return of all payments received for the session.
Model Release:
Photographer may use the photographs taken during the session for purposes of display, advertising, portfolio, website, or any publication to promote Justine Webster Photography. Photographer will never display the photographs in a negative or derogatory light, or use the photographs for further financial gain outside promoting Justine Webster Photography. The Client hereby releases Justine Webster Photography from all claims and liability relating to said photographs.
Photographs and Copyright:
All photographs and copyrights are the property of Justine Webster Photography. The Client has permission to reproduce photographs from his or her session for personal use but Client agrees to limit use of the photographs for family and friends only. Any use for business or for monetary gain will be considered copyright infringement. The Client must obtain written permission from the Photographer and compensate the Photographer prior to the Client or the Client’s friends and family publishing or selling the photographs.
Hi-Resolution Images and Image Processing:
The Client will receive the edited hi-resolution images in JPEG form. Photographer will never deliver RAW image files, as these are seen as the raw material in which the final product is made. High-resolution images may contain a mixture of color and black and white images edited at the Photographer’s discretion. An alternately colored version of a photo may be purchased at the current rate from the web gallery provided by the Photographer. Limited color correction and/or retouching are included at Photographer’s discretion. Client may request further changes within reason for an additional charge. Photographer is not responsible for any prints that are not ordered directly from her (the online photo gallery). For best results, the Client with the high-resolution files should order prints through a reputable lab. The Client is obtaining photographs for personal use only and shall not sell prints or authorize any reproductions by parties other than Justine Webster Photography.
No Warranty of Longevity/Storage:
Photographer does not warrant the longevity in quality of any digital media or files delivered to the Client. The Client bears the sole responsibility for backing up, archiving, and maintaining the integrity of the files. The Photographer will store digital photograph files for 90 days as a courtesy, but will not be held liable for storing these files.
